Terms of Service

1. Introduction

These Terms govern your use of craftwebstudio.ge (the “Site”) and any services Craftwebstudio offers (web design, development, SEO, hosting configuration). By using the Site or commissioning a service, you agree to these Terms. If you do not agree, please do not use the Site.

2. Service Conditions

• Engagement: Project scope, price and timeline are set out in a separate written agreement (proposal + contract).
• Payment: Standard terms — 50% upfront at project kick-off, 50% on delivery. Recurring services (hosting, SEO) are billed monthly.
• Change requests: Work outside the proposal scope (scope creep) may incur additional fees. Changes are confirmed in writing.

3. Intellectual Property

• Upon full payment, you receive the right to use the delivered website (code, design and any content you supplied).
• Craftwebstudio retains rights to third-party open-source code (Next.js, React, Tailwind, etc.) — used under their respective licenses (MIT, Apache 2.0).
• Craftwebstudio may showcase the completed project in its portfolio unless you request otherwise in writing.

4. Client Responsibilities

• Timely delivery of content (text, photos, logos, branding).
• Accounts for any third-party services the project requires (Vercel, Cloudinary, Resend, etc.) — typically created and configured on your side, unless agreed otherwise.
• Safe storage of confidential information (passwords, API keys).

5. Liability Limitations

Craftwebstudio is not liable for:

• Disruptions or termination of third-party services (Vercel, AWS, your hosting provider, search engines).
• Modifications to the codebase made by you or any third party after delivery.
• Data loss caused by deletion of database records or files initiated on your side.
• Inaccurate or incomplete information you provided.

Aggregate liability is capped at the amount you paid Craftwebstudio for the relevant service in the preceding 12 months.

6. Personal Data

Craftwebstudio handles your personal data in accordance with GDPR (Regulation 2016/679) and the Georgian Law on Personal Data Protection (2014). For details see our Privacy Policy.

7. Warranties & Service Continuity

• Bug-fix window: Free bug fixes for 30 days after delivery (code defects only). Content changes are not included.
• Hosting: Standard uptime monitoring is in place but we cannot guarantee 99.9% availability. Customers needing strict SLAs must agree a separate hosting contract.

8. Termination

Either party may terminate the engagement with written notice. Amounts paid for completed phases are non-refundable. The unstarted portion of an in-progress phase is refunded on a pro-rata basis by mutual agreement.

9. Changes to These Terms

Craftwebstudio may update these Terms. Material changes are published on this page with a new last-updated date. Continued use of the Site after an update constitutes acceptance of the revised Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Georgia. In the event of a dispute, the parties shall first attempt resolution by negotiation. Failing that, jurisdiction lies with the Tbilisi City Court.
